What Has Changed? Expansion of Federal Diversity Jurisdiction. CAFA amends diversity jurisdiction to allow federal courts to hear most class action lawsuits, including indirect purchaser antitrust lawsuits brought entirely under state law.21 The Act reverses the old rule requiring complete diversity between each named plaintiff and each defendant, and establishes a rule of minimal diversity. Under the new Section 1332 d ; 2 ; , if "any member" of a plaintiff class is a citizen of a state that is different from "any defendant's" place of citizenship, the case can be heard in federal court, assuming the other requirements of the statute are met. The former diversity statute disregarded the citizenship of individual class members and only looked to the citizenship of the named plaintiffs for purposes of determining whether complete diversity existed.22 This change to looking at the citizenship of each class member obviously makes it much more likely in a large class action that diversity will exist, because at least one of the class members in all but the most localized of controversies is likely to be a citizen of a different state from one of the defendants in the action. In addition, whereas in Zahn v. International Paper Co., 414 U.S. 291 1973 ; , the Supreme Court held that the former diversity statute required that each class member meet the "amount-in-controversy" threshold now $75, 000 per person ; , CAFA creates a $5 million threshold that is determined by aggregating all damages demanded for the entire class.23 Whereas few class actions involve potential damages of over $75, 000 per class member, most consumer class actions would easily meet the $5 million aggregate threshold, a figure that would be considered modest for most antitrust cases, even those limited to residents of a single state. The Senate Report states that the Committee majority's intent is that where there is any doubt about whether these jurisdictional prerequisites are met, "the court should err in favor of exercising jurisdiction over the case."24 The Report also purports to put the burden on the plaintiff to show that a case should be remanded to state court, 25 even though the Act itself does not explicitly say that, prior law put the burden on the party seeking removal to establish federal jurisdiction, and the removal statute was strictly construed against removal jurisdiction.26 As discussed above, it is not clear that the courts will look to these statements by the Committee majority as legitimate expressions of congressional intent, because the Report was not circulated until after passage of the Act and particularly given that these changes would reverse existing law without an explicit textual basis in the Act. The Act also removes two other procedural impediments to removal that existed under prior law: the requirement of unanimous consent to removal by all defendants and the requirement that any removal occur within one year after the, because captopril renogram.

S. typhi is in the same family of bacteria as the type spread by chicken and eggs, commonly known as "salmonella poisoning, " or food poisoning. On the other hand, the recently completed ELITE-II study did not demonstrate substantial advantages of AT1-antagonist losartan versus ACE-inhibitor captoril in elderly heart failure patients concerning survival [5]. In this connection we can suppose that the combination of AT1-antagonist and ACE-inhibitor could render positive influence on current CHF [13]. However, RESOLVD did not demonstrate actual advantages of the same combination for long-term prognosis in patients with CHF in comparison with AT1-antagonist or ACE-inhibitor alone. Nevertheless, the AT1-antagonist candesartan and ACE-inhibitor enalapril combination not only prevented the lowering of LVEF, but contributed to a more pronounced increase of LVEF compared to administration of enalapril or candesartan alone during a period of 48 weeks. Besides, in the enalapril + candesartan group patients, LVEDV was slightly decreased, whereas in other groups this effect was not registered [14]. Therefore, AT1-antagonist + ACE-inhibitor influenced the haemodynamic status positively, but did not render noticeable additive operation for the long-term prognosis. The present data show that the influence of AT1-antagonist on haemodynamics and LV remodelling in heart failure patients can have a dose-dependent nature. Thus, the low doses of losartan do not increase essentially the efficiency of CT. In comparison, high doses rendered more favourable influence on haemodynamics and LV remodelling. The recent study showed that AT1-antagonists are capable of enhancing survival in cases of CHF due to limitation of LV-remodelling [15]. At the same time, it is known that the haemodynamic effects of the first dose of losartan is slightly reduced by the first dose of captopril. [16]. The research data demonstrate that the high doses of losartan during the 48 weeks prevented the progression of LV-dysfunction. Taking into consideration that, in spite of the usage of a standard combination ACE inhibitor + diuretic + vasodilator, LVEDV continues progressively to increase and LVEF to decrease. This process is precluded only by the addition of losartan in a high dose 50 mg d ; for not less than 48 weeks. In conclusion, losartan in a dose of 50 mg daily in comparison to losartan 25 mg daily in patients with congestive heart failure promotes a more significant improvement of LV-function and myocardial remodelling, associated with decrease of NYHA CHF FC. It is possible to interpret that a positive influence of high doses of the drug not only on clinical status and haemodynamics, but also on the long-term outcomes can be connected with this phenomenon. Therefore, it is possible to regard usage of AT1-antagonist in low doses as well as in high doses added to ACE inhibitor in therapy of CHF as a clinical experiment.
